Bengaluru realtors scurry for cover with $1 billion bad loans - Cheated Buyers

BENGALURU: Loans worth more than $1billion, or about Rs 6,800 crore, given to various residential developers in Bengaluru over the last few years by non-banking finance companies (NBFC) are in distress and seeking bailouts as developers struggle to repay them due to sluggish sales and stringent regulations enacted recently.











Several of the city’s second rung and smaller builders are being dragged to the National Company Law Tribunal (NCLT) or forced to part with their assets after defaulting on loan repayments. While the heat is mostly on the smaller builders, a few top developers are also in the list as they struggle to refinance the loan books.

This comes even as select projects have reported good bookings in the last two months, though recovering sentiments have eluded vast swathes of Bengaluru's residential market, one of the most resilient in the country.

The list of bad loans, reviewed by this newspaper, shows that 18 developers alone amount to over Rs 5,500 crore, or $800 million, pegging the total distress amount higher than $1billion.

CM Khattar takes on fraud builders- Cheated Buyers

Gurgaon:In a bid to resolve the issues of people who have invested in builder societies in Haryana's Gurgaon city, Chief Minister Manoharlal Khattar on Thursday attended a grievance redressal committee meet and took over nearly 35 cases of absconding builders and constructions moving at snail's pace. 


One such case of the terrible state of societies in Gurgaon is the Shanti Niketan Group Housing Society. The Group Housing Society was registered under Haryana Cooperative Societies Act, 1984 on May 23, 2003 by a group of builders with the commitment to build 96 flats of different denominations. 

They sold the flats at an amount exceeding Rs 70 Crores collected from buyers but the society is yet not complete after 12 years. The construction work stopped in 2010. The builders are not ready to place the documents and accounts of the society in front of the buyers. The hard-pressed members of these sham societies have high hopes from the BJP-led government in Haryana for speedy justice to their money.

Realty cases against Aliens, Lodha, Mantri, others pile up at Telangana state commission.

It's raining complaints from home buyers at the Telangana State Consumer Disputes Redressal Commission. At least so it seems from the official records, which suggest that close to 200 such cases have been filed with the commission in the last one year alone between June 2014 and June 2015.

Prominent builders that find themselves on this list of'accused', include Aliens Group, Lodha Group, Aditya Constructions, Mantri Developers, Lanco Hills, Janapriya, Royal Home Constructions, among many others. Given the ongoing turmoil on the premises of the Tellapur-based Aliens Space Station-I venture, it comes as no surprise that the maximum complaints, i.e. 115, lodged so far are against it.

"Most of these complaints are with regard to an inordinate delay in completing the projects," confirmed an official from the state's consumer affairs, food and civil supplies department, of which the commission is a part. He also added that the numbers are fast increasing with every passing day.

Unfortunately, however, there seems to be no immediate respite in sight for these customers who have been running from pillar to post to recover either their properties or lump sum deposits. This, as the Telangana state commission  even after a lapse of eight months since its separation from the Andhra Pradesh wing is yet to get a president to head its day-to-day affairs. Result, piling of files with no one to attend to.

"It is frustrating to say the least. With the developer not paying heed to our concerns and the government too not intervening in the matter, we have no place to go to for help," said Prashanth V, an aggrieved customer of Aliens Group, while ruing the critical situation facing scores of home buyers who have been left with no choice but to pay hefty EMIs as banks too have refused to cooperate. The tragedy: zero guarantee of a home at the end of the road.

Incidentally, the Telangana government has failed to appoint a president, despite orders from the Hyderabad High Court.

"Our sources tell us that the realty mafia is hand-in-glove with the government in delaying the appointment," said another home buyer on condition of anonymity, adding,"They are waiting for the sector to revive before their cases can come up for hearing before the commission."

While the commissioner of consumer affairs, food & civil supplies, Rajat Kumar, refused to react to these allegations, he did admit to an unprecedented delay in the appointment of the president."There is no denying that. But there are three district consumer forums in the city, so it isn't like there is a major delay in hearing of cases. We are hopeful that the appointment issue will be resolved in the next one month," he said.

Times view: The government should immediately appoint a new president at the earliest considering that the redressal forum is imperative to resolve the grievances of the common man. Apart from Real Estate-related matters there are several other cases, which need speedy disposal.

A landmark Supreme Court judgement has given huge relief to farmers/landowners, while quashing the “illegal” and “deceptive” licensing of 280 acres of land in Rohtak, Haryana in 2006 to Uddar Gaggan Properties Ltd.

This serves as a body blow to former Haryana Chief Minister Bhupinder Singh Hooda and other state officials who are facing multiple probes for facilitating the private enrichment of builders through similar illegal licensing.

“The unholy nexus to promote the private interests” of builders by “transfer of resources of poor for the benefit of the rich”, through “gross abuse of law” and “clear fraud” referred to in the judgement, has been detailed in a series of media exposes, beginning October 8, 2012, first about the irregularities in property dealings involving real estate major DLF and Congress President Sonia Gandhi’s son-in-law Robert Vadra, while later going on to uncover Hooda’s modus operandi to favor a host of other builders, including Uddar Gaggan.

This earlier expose had revealed that Hooda was acquiring land from poor, illiterate farmers at a low rate in the name of ‘public interest’ only to later license this to builders after bestowing out-of-turn favors that helped the land value increase exponentially.

The facts disclosed therein, had pointed to Hooda’s motivation in licensing a staggering 24,825 acres of land during his 10-year tenure as Chief Minister, as against just 8,550.32 acres by successive Chief Ministers in the 23 years preceding Mr. Hooda’s rise to power in 2004.

No relief for Lodha group on sale of flats in Hyderabad's Bellezza project.

The Hyderabad HC on Friday made it clear that it would call for a report from the GHMC on the ongoing tussle between Mumbai-based developer Lodha Constructions and the apartment owners of Lodha Bellezza at Kukatpally .

The bench of acting Chief Justice Ramesh Ranganathan and Justice M Ganga Rao, hearing a plea filed by Lodha Constructions, also refused to vacate a single judge's order restraining the builder from selling flats in Lodha Bellezza and Lodha Meridien and posted the matter to next week.

Earlier, following a plea by Bellezza Apartment Owners Association, a single judge stayed the proposed demolition of acompound wall built between Bellezza and Meridian and di rected the authorities to ensure that no sales are registered in respect of vacant flats. Aggrieved by this, the developer filed a plea urging the court to vacate the stay on sale of flats. But flat owners in the two schemes, particularly Lodha Bellezza, are accusing the builder of misleading them and GHMC.

The bench questioned the builder and the authorities as to how builders were being per mitted to go ahead despite failing to provide basic facilities like parking. Stating that there is no urgency to intervene, the bench declined to vacate the restraint order passed. “At a time we are struggling to reach out to those who are weak and cannot afford to wait for long, we cannot spare time, that too on an urgent basis, for those who can afford to wait,“ the bench said.

Rohini scheme plots likely to be allotted in March 2018

DDA launched the scheme in 1981 for all economic categories in the area spread over 2,497 hectare with an aim to accommodate 8.5 lakh people.

Over 14,000 applicants of the 1981 residential scheme in Rohini are likely to get their flats by March next year, the Delhi Development Authority (DDA) said on Wednesday.

Officials said DDA would complete all civic development works in the scheme by December-end before starting the process of allotment.

“Our target is to complete all development work in the 1981 Rohini residential scheme by end of December. We would then issue allotment-cum-demand letters to the 14,352 allottees within the first quarter of the next year (2018),” principal commissioner (housing) DDA JP Agarwal said.

“Basic infrastructure, such as sewage, water, electricity and roads is still to reach these sectors. According to DDA officials, the development work is being done and it is expected to get completed by March next year,” a DDA official said.

DDA launched the scheme in 1981 for all economic categories in the area spread over 2,497 hectare with an aim to accommodate 8.5 lakh people. In 1981, the scheme offered 1,17,000 plots for which 82,384 people had applied. Of the 82,384 applications, 80,587 applicants were eligible. Some 24,461 applicants got MIG plots, 37,665 got LIG and 18,461 got Janta category plots.

But the applicants have since been waiting for their plots; many applicants have even died.

In fact, the DDA allotted 25,000 plots in 2015 after the Supreme Court’s intervention. According to the DDA, 10,289 plots were allotted in 1982, another 10,103 were allotted in 1983, nine plots were allotted in 2001 and another 750 in 2014.

The proposed scheme comprises plotted, group housing, and other community facilities in Rohini’s sectors 34, 35, 36, 37, and 38. The plot sizes range from 36 sqm to 90 sqm.

Explaining the delay, the agency said in a statement that the scheme was delayed after 1991 on account of various litigations filed by land owner and applicants in the Delhi high court and the Supreme Court.

“The demand-cum-allotment letters of 14,352 allottees are yet to be issued due to delay in development of land, which is likely to be completed shortly,” the statement said.

Brigade enterprises Q4 net profit down 63% on year.

MUMBAI: Realty developer Brigade Enterprises has reported 63.5% on-year decline in consolidated net profit at Rs 27 crore for the quarter ended March. Total consolidated revenue also recorded a 20% on-year dip at Rs 448 crore, the company said in a release.

The Bengaluru-based company’s operating profit decreased to Rs 149 crore as against Rs 205 crore a year ago.

During the year 2017-18 (April-March), the company’s net profit declined 3% to Rs 149 crore, while revenue also declined 5% to Rs 1,946 crore.

“The financial year 18 has been a challenging year in the light of recent policy changes like Real Estate Regulation Act & Goods and Services Tax Act in the Real Estate Industry, We are optimistic on the future given our existing pipeline of projects across various segments i.e. real estate, commercial leasing and hospitality,” said M.R. Jaishankar, Chairman and Managing Director, Brigade Enterprises.

The group is currently developing about 20 million sq ft across residential, office, retail and hotel segments. Further, launches to the extent of about 12 million sq ft are planned for the financial year 2018-19 across the 4 segments including around 5 million sq ft in the affordable housing segment.

Bombay HC appoints senior lawyer to represent Orbit flat buyers

In a relief of sorts for flat buyers in stalled Orbit projects, the Bombay High Court on Monday appointed senior advocate Shiraz Rustomjee to represent aggrieved buyers of flats and commercial properties and tenants in the company’s meeting of creditors, when it is called. Justice SJ Kathawalla, who has been hearing the high-profile case filed by flat-purchasers of the stuck Orbit Terraces project passed the order appointing Rustomjee after all parties, including the banks, gave a no-objection.

While the move was welcomed by many, all claims cases related to Orbit Corp, filed before the HC, are likely to come to a standstill if the National Company Law Tribunal (NCLT) admits insolvency proceedings filed by State Bank of India against Orbit.

Orbit Corp had borrowed Rs 135 crore from the consortium of SBI and Union Bank of India by creating a charge on the project in their favour. It had re-paid around Rs 76 crore before it stopped work on the project in 2014.

The creditors’ meet, for which Rustomjee has been appointed, will happen only after the NCLT admits the case and appoints an Insolvency Resolution Professional (IRP). The IRP will then call for a Creditors’ meeting. Once an IRP is appointed, the board of the concerned company is suspended. The IRP is given a period of 180 days, which is extendable up to 270 days, to turn the company around. If the IRP is unable to manage this within the given time frame, the company goes into liquidation – meaning its assets would be sold off to pay of its debts – automatically.

But the appointment of IRP by the NCLT will automatically bring to a halt all claims filed against Orbit before all courts, even as a few purchasers were pooling in money and hoping to reach a resolution.

In the case of Orbit Terraces, the aggrieved flat buyers had initially offered Rs 45 crore to the banks and later increased the amount to Rs 60 crore by way of final settlement for the balance debt on Orbit.

SBI had, last month, informed the HC that they had filed Insolvency proceedings against Orbit at the NCLT. The flat-purchasers in the Orbit Terraces project, represented by Advocate Vivek Shiralkar, have filed an intervention application in the NCLT in those proceedings.

Inspection against 3 realtors to continue - Dugar Housing

CHENNAI: In the face of the Supreme Court staying the National Green Tribunal's (NGT) order regarding sealing building projects of two promoters in Chennai, the principal bench of the National Green Tribunal New Delhi has clarified that the stay pertains only to the two realtors and inspections against three other promoters will continue.

Earlier, the projects of four realtors.Ruby Manoharan Property Developers, Dugar Housing, SPR and RG Construction and Y Pondurai were sealed for going ahead with construction activity in violation of the tribunal's order. The tribunal, however, later de-sealed the projects of Y Pondurai and Ruby Manoharan Property Developers in the absence of documentation to show that they had violated the tribunal's order. Dugar Housing along with SPR and RG Construction moved the apex court which in its order stayed the NGTs order.

Y Pondurai, Ruby Manoharan Property Developers along SSM Builders and Promoters (which was also slapped with fine for building violations) then filed an application before the tribunal seeking completion of the committee inspection, filing of its report and processing of their environmental clearances.

On Friday, Abdul Saleem, special government pleader for the state, TNPCB and CMDA appeared before the tribunal. He said the three project proponents had paid the fine as ordered by the tribunal. The committee, however, had stopped inspection works because of the apex court's order.

The tribunal clarified that the stay pertained to only two promoters and the committee should complete the inspection and file its report with regard to the other three. The matter has been posted to October 19 for the committee to file its report and for TNPCB and SEIAA to submit their replies

Competition Commission of India rejects charges against Terra Group .

NEW DELHI: Anti monopoly watchdog Competition Commission of India (CCI) has rejected charges of abuse of its dominant position against against builder Terra Group, also known as Adinath Properties Ltd.

Complainant Rahul Sharma had alleged before the CCI that the realty firm abused its dominant position to impose additional charges on his purchase of a plot in ‘Terra City’ project of the firm on the Alwar Express Highway in Bhiwadi. 

The CCI observed that the relevant market of provision of the services of development and sale of residential plot in Bhiwadi and its nearby areas “is highly fragmented with the presence of large number of builders and developers having multiple projects” and many firms are engaged in the service of development and sale of residential plot hence “buyers have options to switch to other builders/ developers in the relevant geographic market”. 

In his complaint, Sharma has alleged that after an agreement was signed between him and Adinath Properties for the sale of the plot, the latter demanded certain additional charges such as Rs 60,000 towards proportionate cost of electrical line and substation equipment cost, Rs 24,000 for sinking fund and Rs 25,000 for club charges.

Sharma alleged that the said charges were not agreed between them as per the allotment letter and the original agreement. 

Additionally, Sharma alleged that he was told to sign a maintenance agreement with the maintenance agency nominated by Adinath Properties and he was asked to pay maintenance charges at the rate of Rs 8 per sq yard. Sharma also alleged that the realty firm had arbitrarily nominated the maintenance agency and fixed the maintenance charges without taking his consent.

Shop owners accuse Navi Mumbai mall developers of fraud by Akshar developers.

The shop owners at City Centre Mall in Navi Mumbai have filed a criminal case against the developer of the mall in the Vashi First Class Court, accusing them of fraud.

Speaking on behalf of the shop owners, their lawyer, Nelson Rajan, said,"At present, the judicial magistrate has deferred the hearing till December 15. However, the 

magistrate has warned all the 15 individuals of the defending party to be present in the court on December 15, or else the order will be passed on the same day."

The shop owners have accused the developers Wellwisher Constructions & Finance Pvt Ltd and Akshar Developers of deceiving them. The shop owners have alleged that the developers had made them sign an'agreement for lease' instead of the 'agreement for sale', despite receiving the full payment in 2007 from each shop owner.
The owners said that the reason why they didn't object to this move initially was because the developers had assured them that it would neither affect them nor their business. 



However, now that the mall has reportedly changed hands, the developers have asked the shop owners to vacate the shops, forcing them to move court.

Sensing that a single shop owner would not stand a chance fighting the powerful developers, the shop owners united under the banner of City Centre Mall Shop Owners 

Association (CCMOA). According to R K Sharma, chairperson of the association, "It is written in the allotment letter that we have bought the shops in the mall. 

However, at the time of signing an agreement, the developers forced us to sign 'agreement for lease', saying that the land for the mall had been taken on lease from 

CIDCO. As we had faith in them and were ignorant about the rules and regulations, we bought their theory and signed the agreement. None of us had ever thought that 

something like this would come up in future." 

The shop owners said that they didn't doubt the developers' integrity, until the management started ignoring basic maintenance and repair work of the mall. "In early 

2010, when we noticed the management's lack of interest in executing restoration work, we questioned them for their negligence. They dodged us by saying that the mall 

has been transferred to Bombay Infrastructure Private Limited. A few days later, we received letters from the original developers and the new one, asking us to vacate 

the shops, as they were given to us on lease," said a shop owner, requesting anonymity.

Commenting on the issue, city-based real estate experts are baffled over the developer's decision of forcing the shop owners to sign an agreement for lease, when the 

allotment letters talk about sale of the shops.

When contacted, Abhijeet Bhansali of Wellwisher Constructions & Finance Pvt Ltd said, "I do not have information on the issue, so I cannot comment on it. Our lawyer is following the case in the court."

DLF 2 homes used for illegal activities on DTCP radar in Gurugram.

The department of town and country planning (DTCP) has begun a survey in DLF 2 to identify residential properties being used illegally for commercial purposes. Around 160 such properties have already been identified, and the department intends to issue notices to the owners by next week. The properties of those who fail to comply with land use norms will be sealed, DTCP officials said.

The survey was started after residents of The Villas and DLF Oakwood Estate, both of which are located in DLF 2, wrote to the CM Window over the matter. So far, DTCP junior engineers have shortlisted 159 such properties, all of which are residential houses operating as commercial establishments. According to an estimate, close to 10% of residential houses in DLF 2 have been converted into shops, service centres, salons, boutiques, gymnasiums and paying guest accommodations.

The application submitted by residents at the CM Window, dated March 24, states that illegal commercial establishments “have become dens for all kinds of nefarious activities like drinking, drug taking, gambling and even prostitution… Besides this, there is a severe stress on infrastructure like electricity, water, etc, as these were designed for residential use”. 

“These commercial establishments are violating Master Plan and land use provisions. Far too many vehicles are parked on the lanes next to these establishments, and we face traffic snarls daily due to these. Around 3,000 residents are suffering. There have been several incidents of snatching. We’re afraid to let our children go out and play, and women can’t roam around freely,” said Ashish Chopra, an architect who lives in the area.

JAIPUR: The protest at Nindar village here against the alleged forced acquisition of land by the Jaipur Development Authority (JDA) for a housing project has intensified, with villagers going on a hunger strike.

For over a week now, farmers affected by the acquisition have been digging pits and burying themselves neck-deep in them.

The protesters alleged the state government was not "serious about resolving their issues".

"The JDA Commissioner had, in the presence of the urban development and housing minister, assured resolution of our problems.

"He had agreed to conduct a fresh survey of our land. But now they have reneged on their promise," Nagendra Singh Shekhawat of Nindar Bachao Yuva Kisan Sangarsh Samiti said.

Due to government apathy, 33 people gave up food yesterday and around 30 others have gone on a relay hunger strike at the protest site.

Shekhawat claimed the farmers had told the state government that "the survey conducted by the JDA was wrong".

The protesters are against the acquisition of more than 1,300 big has of land for Rajasthan Housing Board project as "the compensation offered is not enough", he said.

The JDA has taken possession of 600 big has of land so far and deposited Rs 60 crore in a local court as compensation for it after villagers refused to accept the amount, claiming it did not hold up to the prevailing market rates.

Rajasthan Housing Board moves against defaulting residents

JAIPUR: After 27 years, action will be taken against those living in flats/houses of Rajasthan Housing Board (RHB) without paying dues.

A list of 2,016 occupants, who have not cleared the dues till date, has been prepared by the RHB. Following the directions of urban development and housing (UDH) minister Shrichand Kriplani, officials are all set to issue notices to defaulters. “The issue was discussed at a recent review meeting. We will start distributing notices in the next 15 days,” said a senior RHB official.

In 1982, action was taken against a defaulter who was living in a RHB residence without settling dues. “The defaulter approached the court and got relief. Since then, RHB has never taken action against such defaulters. Now, notices are being prepared,” added the official.

Other than this, RHB is also seeking permission from the state government for deacquisition of land after the latter imposed a ban on developing new housing projects. The RHB has requested the state government to grant permission for developing new housing projects, or allow the process of deacquisition. In Jaipur and other parts of the state, the RHB has started land acquisition of 5,324 hectares from farmers to develop housing projects. Notices have also been issued to farmers.

According to sources, chief minister Vasundhara Raje imposed a ban on Rajasthan Housing Board after seeing houses constructed using inferior construction material during a visit to Nagaur in 2016. Following this, the then chief secretary, C S Rajan, issued official orders on May 24, 2016. In October, the state government also issued orders and banned land acquisition. However, before the orders were issued, the RHB released the award for 2,219 hecatres of land acquired for 22 housing projects. Now, the RHB has to pay compensation of approximately Rs 1,350 crore to farmers.

“The RHB has asked for land for settlement from the state government. Permission has been given to pay land as compensation in such cases till September 2017,” added an official.

Trump brand debuts in Delhi-NCR market, hopes to generate over USD 1bn from all properties in India

Global real estate brand Trump Towers that made a debut in the Delhi-NCR market on Wednesday, with a fourth property after Mumbai, Pune, and Kolkata, hopes to generate roughly over a billion dollars in terms of sales potential from all its properties in India.

“We hope to generate roughly well over a billion dollars in terms of sales potential of all the Trump properties in India,” Kalpesh Mehta, partner of Tribeca, India representative of Trump Organisation told Moneycontrol.

US President Donald Trump’s eldest son, Donald Trump Jr, is expected to be in India in the first quarter of 2018 “to celebrate the success of both the Delhi-NCR project and the Kolkata project.” “Plans are underway and I am hopeful that he will be here in the first quarter of 2018,” Mehta said. “The total project cost of the luxury residential project to come up in Gurgaon is Rs 1,200 crore,” he said. M3M and Tribeca will develop 250 ultra-luxury residences under a brand license from The Trump Organisation. The project is also expected to have a 35,000 sq ft area of amenities.

Trump Towers Delhi-NCR will be characterised by iconic twin towers rising over 600 feet that will be amongst the tallest towers in the region. “True to Trump form this will be an all-glass building rising 600 ft in the area and seen from everywhere,” Mehta said.

On offer are three sizes – 3500 sq ft apartments, 4500 sq ft apartments and 6000 sq ft apartments. In the first phase of sale, the apartments which will have three and four bedroom options will be sold in a price range of Rs 5 crore to Rs 10 crore. "This will be the biggest Trump project in India with a development of over one million sq ft," Mehta said, adding the company is looking at targeting high net worth individuals and NRIs to sell the project.

The Delhi-NCR project is the fourth Trump Tower project in India after Pune, Mumbai, and Kolkata. In Pune, the global brand has licensed the Trump name to Panchshil Realty, in Mumbai to Lodha Group and in Kolkata, the Trump Organisation has partnered with Unimark Group to build a 400,000 sq ft residential project with the signature Trump Tower on the city’s EM Bypass stretch.

Developer held for cheating flat buyers of Rs 25 crore

MUMBAI: The economic offences wing (EOW) of city police have arrested the director of a construction company for allegedly cheating 40 flat buyers of Rs 25 crore.



In 2010, A&A Shelters Pvt Ltd., had allegedly promised the buyers to deliver flats in a Kandivili project within three years. However, even after six years of making payments, the 40 buyers are still waiting to get their dream homes. Subsequently, six FIRs were registered against the directors of the firm in Amboli police station.

While Abhishek Vyas, the prime suspect, has been arrested now, Vishal Dattani, another director of the firm, is already in judicial custody. “Vyas wanted to redevelop 10 societies in Amboli area. He demolished two societies and promised to pay rent to the tenants. Meanwhile, around 40 people booked flats in his newly promised project in 2010,” said a police source. While he promised to hand over the possession within three years, no work has started, said the officer.

“During interrogation, Vyas told police he had been trying to get all the clearances from Mhada but the work got stuck. The worried buyers then approached the Amboli police and filed six separate FIRs against him and others,” police said.

“We have frozen more than 12 bank accounts belonging to Vyas, co-accused and his firm. We have also written to the Indian Banking Association to freeze all his banks accounts across the country,” added the officer. The police have also approached various sources including banks to know if Vyas or his firm took loan for this project or mortgaged it.

A police action report is likely to be sent to Mhada about the firm. “All the investors who approached the police had booked flats in the saleable area. Vyas told us that he had used the money to distribute rent to the tenants, repay loans and do miscellaneous works,” added the police.
The EOW has in the last six months arrested at least four developers for not handing over flats/houses to buyers in time.

Neither homes, nor refund as builder delays project in Sanand

They had a dream… of owning a weekend home. After some efforts, they found a place where they would want to build that home. Payment was made and they waited to get possession of the plot. What was to happen in three months did not appear to be happening even after a few years. A few days ago, some relief did come when the Consumer Dispute Redressal Forum (CDRF) directed the company to refund the amount with interest. But even that money does not appear anywhere in sight.

Legal action against Builder - Cheated Buyers


Pallavi Chauhan, Gurucharan Kaur and Nirmal Kaur had booked a plot each in a scheme announced by India Green Reality Ltd near Zamp village in Sanand taluka. While Gurucharan and Nirmal are related, Chauhan is the former’s neighbour.

They paid Rs 3 lakh in installments for the plots (E-261, E-262 and E 271) measuring 150 square yards. They even got the banakhat (agreement of sale) done. “We were told that the scheme had NA-NOC title clearance as well as other required permissions. This was highlighted in the advertisements. The scheme also had four-five wooden houses. We were assured that we would get possession of the plot within three months, but that did not happen,” said Chauhan. Despite repeated requests, they failed to get a satisfactory response from the realty firm. They then decided to seek refund of Rs 3 lakh.

In July 2013, they sent a letter on stamp paper to a company asking for cancellation of the booking. However, the company allegedly ignored them. A legal notice sent to the company in March 2014 too remained unanswered. In February 2015, the trio approached the Consumer Dispute Redressal Forum (CDRF), Ahmedabad Rural, and lodged a complaint. They sought that they be either given possession of the plot or a refund.

However, a notice in this regard too went unanswered. Their advocate Anand Parikh then filed an amendment application seeking only refund. This time, the company authorities replied, saying that they were ready to give the plot.

When Parikh asked them to produce the NANOC in the court, they could not. Parikh then filed a rejoinder saying that his clients wanted only refund, not the plot. This application was allowed by the court. Advocate Anand Parikh says, “The plot was booked in 2011. I produced photographs of 2017 of the land. It shows that there was no such development that would allow any construction. They couldn’t even produce NANOC certificate before the court.”

Court orders FIR against Gurugram's Homestead Infrastructure for cheating 900 homebuyers

GURUGRAM: A city court has directed police to book a Gurgaon-based developer for duping nearly 900 home buyers.

Homestead Infrastructure allegedly sold flats to the buyers in a housing project in Sohna without having land and required licence for the same. The company started collecting money from people in 2013-14 for its project ‘City of Homestead’.

Judicial magistrate Ist Class Ravish Kaushik ordered the registration of an FIR for fraud and cheating against the developer, observing that it was a “criminal office which requires proper investigation” as Homestead took money from buyers without having any land or necessary licence for the project.

“The circumstances warrants for proper investigation in the matter, which can be done by police only. The police station concerned is directed to register the FIR under relevant sections and investigate the case from all angles,” the court said.

Yogendra Ambardar, who had invested in the project, said the developer promoted the project in the name of Formula 1 legend driver Michael Schumacher. “The developer advertised the project and interested buyers were taken to the spot, shown maps and plan,” he said.

As work did not start in the project, some buyers started an investigation on their own and realized that site visit was just a set-up and developer do not even have land. “We gave money and now realized we have been cheated,” said Ambardar.

Manjesh Kumar, one of the petitioners, said they complained to different departments and even approached police, but they refused to take action. “Finally we approached the court in August and now it has directed to file an FIR against the company,” he said.

On the directions of a Delhi court, an FIR has already been registered against Homestead directors and tennis star Maria Sharapova for its another project, ‘Ace by Sharapova’ in Sector 73, Gurgaon. “They launched two projects, one in Gurgaon and another in Sohna, and promoted them in the name of big global sports stars but delivered none,” said Nand Singh, another home buyer. Despite repeated attempts, the developer could not be contacted.

HUDA blacklist architects for forging photographs for completion certificate

GURUGRAM: The Haryana Urban Development Authority (HUDA) has blacklisted three architects for forging and submitting wrong information while applying for completion certificate (CC). The move was aimed at checking corruption in granting CC by Huda, which has emerged as one of the major source of corruption in the department.

The action was purportedly taken by the Estate officer while checking the files submitted to him by survey branch for approval. It was found that the architects had submitted morphed photographs of the sites showing them complete in all respect while a special team so constituted by the estate office found the same to the contrary on spot inspection. “Inquiry has been marked into the matter and will call for explanation of the concerned officials of the survey branch and necessary departmental action along with criminal proceedings shall be initiated post an enquiry,” said estate officer-II of Huda Vivek Kalia.

People having plots in HUDA sectors have to take CC from authority after completing construction. Getting CC is mandatory to get services like water, sewerage and power connection. In January 2017 Huda made it mandatory for all kinds of plots—residential, commercial and institutional to complete construction of minimum of 50% of ground coverage and gets CC. Failing to get CC in stipulated time Huda will automatically start charging the penalty as extension fee.

In most of the cases people submit forged photograph to get CC by greasing the palms of Huda officials. With the jurisdiction over sectors 23-80 were most of the construction activities are in progress, estate office-II of Huda Gurgaon has emerged as powerhouse amongst all the estates offices of authority in Haryana and thus a natural ground for touts and middle men. On increasing irregularities in granting CC, Kalia said initiatives are being taken to re-structure the entire processes of HUDA and probable solutions have already been proposed by his office to the headquarters and shall be introduced shortly. “Reliance on information technology and absolute or limited manual interface can cut down on wrongdoing which often we hear on a daily basis.

Besides, the onus is also on the citizenry to report such matters to senior officials of HUDA or on other such online grievances portal so made available to them in case of any issue,” said Kalia urging people to approach senior officials in case they face problem. He further states that a special whatsapp number monitored by the Vigilance branch of HUDA shall be introduced this week wherein applicants/individuals can lodge formal complaints of any official or non-official persons while dealing with Estate Office of HUDA.
