File Cheating Case against Builder - Cheated Buyers


The directors of controversial real estate company AN Buildwell may soon land in trouble. Judicial magistrate first class Jyoti Grover has directed police to file an FIR against its directors, and provide the court its compliance report by April 24. The direction was issued against a complaint filed by buyers of Spire Edge and IT Park, developed by AN Buildwell in Sector 8, Manesar. The project was launched in 2008 over 10 acres of land, and 1,274 people invested in it under an assured return scheme.

“The developer had promised to give us assured returns, but stopped paying us from 2014,” said Renuka Kulkarni, complainant, who said the developer had lured buyers like herself with promise of assured returns. She added that even the terms of their agreement were changed arbitrarily. “Units were sold with a 99-year-lease, but the lease period was later reduced to 29 years in a one-sided agreement,” said Kulkarni, who filed the complaint with economic offence wing (EOW) of Gurugram police after she refused to sign the agreement.

But no action was taken by police. In the meantime, all directors of the company resigned, and the company went into liquidation. “They (developer) went into liquidation to avoid legal action,” said Kulkarni. With police unhelpful, she filed a case before the Gurugram court in 2017, against 18 people, companies including AN Buildwell and its associates, and its directors. 

Umesh Gulati, counsel for the complainant, said EOW told the court that no action was taken in the case as there’s another case against the company pending before Delhi high court. “Pending proceedings against AN Buildwell before Delhi HC is related to liquidation, and there is no stay against any criminal proceedings proposed to be taken by any aggrieved person,” said Gulati.

The court observed that there was enough material to probe the allegation against directors S K Hooda, Sandeep Hooda and Sunil Gandhi. It also observed that since the involvement of the other employees and associate companies in the offence is not clear at this stage, they need not be included in the FIR. If anything comes up against them during the probe, their names should be included then. Despite repeated attempts by TOI, the developer could not be contacted for their reaction.

Court rejects anticipatory bail for Lucknow builder who cheated Gurugram buyer

GURUGRAM: A Lucknow-based real estate company, which was booked for allegedly taking money from an investor for a unit in a commercial tower and later selling the same to another buyer, failed to get relief from the sessions court as its anticipatory bail application was rejected.

Following the direction of the court on September 9, a case was registered against Welldone Technology Parks Development Private Limited, its directors Umashankar Halwasiya, Sanjay Khurana and managing director Mukund Halwasiya, under sections 406 (criminal breach of trust), 420 (cheating) and 120B (conspiracy) for cheating Suresh Kumar at Sadar police station.

Sanjay Khurana, Mukund Halwasia and Umashankar Halwasiya had filed an anticipatory bail application in the sessions court, through their lawyer Ravinder Kumar, claiming that they were falsely implicated in the case even after paying the assured Rs 70 lakh to the complainant. "The site (shops) was changed and re-allotted with the consent of the complainant and no loss was borne by him," contended Kumar before the court. The public prosecutor argued that the company cheated the complainant by selling its floors to other parties without his consent.

Advocate Vishal Gupta said complainant Suresh Kumar had purchased a 1,500 sq ft unit (unit number 101A) on the first floor of Welldone Tech Park on Sohna road in 2008, after paying Rs 45 lakh. In 2010, the developer contacted Kumar and told him they had sold his unit (number 101A) by mistake. In 2015 Kumar found that his unit was shifted to 212A from 401A. Later he came to know that all the units were sold to different persons way back in 2010.

After hearing the contentions of both parties, additional session judge Balwant Singh in his order dated September 14 observed that the accused were first alluring the complainant for selling their property and then re-selling the same to third party at a higher rate.

GURUGRAM: The district town planner, Gurugram, has referred the issue of flawed building design and “unwarranted” construction of a tennis court in the green area of GPL Eden Heights, Sector 70, to the senior town planner (STP).

The move has come as a relief to residents who are miffed with the builder for turning the green area in front of E Tower into a tennis court and have been complaining of seepage of water into the basement of D Tower and subsequent weakening of pillars on which their apartment stand.

In a letter to residents, the DTP has informed, “Your complaint is being forwarded to the STP for examination... The complaints of falling of plaster due to weak structure and other issues are being forwarded to the builder for comments.”

Residents of Tower D have been reeling under the fear that the pillars on which their apartment building stand could collapse any time as water is seeping out from the ceiling of its basement over which a garden is spread. “The issue has been pending for one-and-a-half years. We began noticing seepage at many places in the basement. We constantly wrote about it to the developer. Finally, nearly three months ago, the builder sent a team to fix the issue. But we are still grappling with this problem,” said Singh, adding, “We are now realising that it must be a design flaw because we keep fixing one seepage after the other and yet they eventually show up.”

Residents have also alleged that the builder did not ask for their permission for a tennis court in an area marked as a green belt in the original brochure they got during purchase of the property in 2013. “For the past three years, they have been constructing this tennis court on what was supposed to be a green area in front of my house,” said Manish Raina, a resident of E Tower.

Residents said the tennis court, along with the badminton and basketball courts, was meant to be built in another area. “However, the builder turned that area into an open parking and is planning to sell it off and the tennis court is being built in the green area. When we enquired about it, the builder said the township would still have the amount of green area mentioned in the brochure. But how can they make this arbitrary re-alignment without taking our consent?” asked Jasvinder Singh, another resident.

Somika Chandhok, another resident, who filed a petition in the matter with the NGT in January 2017, said, “We kept going from one authority to another but to no avail. We want the RWA, which is still with the builder, to restore the green area.” GPL Eden Heights is spread over 11 acres and has nearly 580 units with nine towers.

The Central Bureau of Investigation (CBI) on Wednesday filed a chargesheet against Virendra Mhaiskar, chairman and managing director of IRB Infrastructure Developers Limited, and 17 others for criminal conspiracy and attempting to cheat the state by grabbing massive tracts of government land at village Pimpaloli along the Pune-Mumbai expressway for a proposed integrated township project.

The case was initiated in 2009 by RTI activist Satish Shetty, who was murdered in January 2010. The then sub-registrars of Lonavla and Maval talukas in Pune district and a lawyer are among the accused named in the chargesheet, which was filed in the court of special judge (CBI) A K Patil here. Mhaiskar and 11 others later appeared before the court, which granted them bail. The court also allowed Mhaiskar to travel abroad on conditions.

IRB Infrastructure Developers Limited is the holding company of the IRB Group. Its subsidiary, Ideal Road Builders Private Limited, was given the contract to maintain the expressway from August 2004 to 2019. Aryan Infrastructure Investments Private Limited is the other IRB subsidiary and real estate development arm which was involved in the purchase of land between 2007 and 2010. The sale deeds for some of these lands were later scrapped through a cancellation deed.

For the township project, the IRB Group had purchased 559 acres land at Pimpaloli from January 17, 2007 to June 23, 2010 and another 794.76 acres in village Taje from January 17, 2007 to April 18, 2011, the chargesheet stated. Most of these lands had already been acquired in the name of the Maharashtra State Road Development Corporation (MSRDC), which built the expressway, between 1995 and 2000, it added.

IRB Infrastructure Developers Limited, in a disclosure to the Bombay Stock Exchange and National Stock Exchange on Wednesday, which was signed by Mhaiskar, stated, “The company and its officials have been fully cooperating with the authorities during the course of the investigation and have provided all information and documents upon request.”

The disclosure further read, “We deny all allegations made against Mhasikar, Gadgil and the company in this matter and will seek appropriate remedies under the law.” Lawyer Rohit Takavane, who appeared for two of the accused who were arrested earlier in the case by the Lonavla city police and later released on bail by the Vadgaon Maval court, said, “The CBI court allowed our plea to continue the bail granted to the two accused on the same terms as laid down by the magistrate.”

The economic offences wing (EOW) has booked four persons, including chairman and CEO of real estate firm Omaxe Ltd, for forgery and fraud in selling plots developed on government land to a customer in Omaxe City-1 township in Mayakhedi area of Indore.

The realtor had constructed the colony, Omaxe City-1, by encroaching upon government land and sold the same portions to the complainant Puneet Govil, EOW superintendent of police Manoj Singh told TOI. Govil had lodged a complaint with the EOW alleging that he had purchased nine plots in Omaxe City-1 in 2011, of which six were found to be on government land.

During investigations, the EOW investigators found that Govil had made the payments to the tune of Rs 16 lakh through cheques to Omaxe Ltd. He had also met firm’s chairman Rohtas Goel and CEO Mohit Goel in firm’s office in Delhi and brought the matter to their notice. No action was taken by them, EOW sources said.

In November 2012, Indore tehsildar had conducted a probe into government land being encroached upon by the builders on Omaxe City-1 project. It was found that the builders had encroached on 1.495 hectare of government land.

Subsequently, the tehsildar court had awarded a fine of Rs 30 lakh on Sanjay Gupta, who had appeared on behalf of M/s Shraddha Buildcon Pvt Ltd and M/s Navratan Buildtech Pvt Ltd. The tehsildar also ordered removal of encroachment. Govil’s plots were developed on the government land encroached by the builders, thereby directly indicating that the real estate firm had prepared fake maps of the township to sell plots to the complainant, EOW official said.

Following initial probe, EOW registered a case against Rohitas Goel, Mohit Goel, Omaxe Projects regional head Sanjay Gupta and project’s liaison officer Shashank Shekhar for fraud, criminal trespass and forgery.
